# Terms of Service for `PRTN AI`

## 1. Provider and scope
These Terms of Service govern the use of the `PRTN AI` app, the website `https://prtn.ai`, and all related free and paid services.

By using `PRTN AI`, you agree to these Terms of Service.
## 2. Description of the service
`PRTN AI` is a protein-tracking app. The app may in particular allow you to:
- use an account, initially including an anonymous account,
- create and store protein entries,
- calculate and manage protein goals,
- search for foods,
- save custom foods,
- receive AI-based estimates based on captured or uploaded images,
- optionally connect `Apple Health`,
- receive push notifications,
- purchase paid subscriptions for premium features.
We continuously develop `PRTN AI`. Features may be added, changed, or discontinued where this is reasonable for users.
## 3. Account and access
You may initially use `PRTN AI` without traditional registration. In that case, an anonymous account is created. You may optionally link your account using email, `Apple Sign-In`, or `Google Sign-In`.
You must:
- provide accurate information,
- keep your credentials confidential,
- not share your account with third parties,
- notify us promptly of any misuse.
We may suspend or terminate accounts if there is a breach of these Terms, abusive use, or unlawful behavior.
## 4. Age requirements
`PRTN AI` is intended for users aged 13 and older.
If you are a minor under the law applicable to you, you may use `PRTN AI` only with any consent required from your parent or legal guardian. Paid subscriptions or purchases may only be made where permitted under applicable law and the rules of the relevant app store.
## 5. Paid subscriptions
Certain features of `PRTN AI` are paid. Prices, terms, and included features are shown to you before purchase in the relevant store or in the app.
For paid subscriptions:
- purchases are made exclusively through the `Apple App Store` or `Google Play Store`,
- there is currently no free trial,
- payment processing is handled by the relevant store,
- cancellations must be made through the relevant store,
- refunds are subject to the policies of the relevant store and are processed through that store.
Where a store offers an automatically renewing subscription, that subscription renews according to the rules of the relevant store unless cancelled there in time.
## 6. Permitted use
You may use `PRTN AI` only in compliance with applicable law and these Terms of Service.
In particular, you must not:
- use the app for unlawful purposes,
- circumvent technical protection measures,
- disrupt or overload the app or related systems,
- scrape or extract the service in an abusive automated manner,
- upload unlawful, infringing, or fraudulent content,
- use the app in a way that infringes third-party rights.
## 7. Important health and liability notices
`PRTN AI` is not a medical device and does not replace medical, therapeutic, nutrition, or dietetic advice.
In particular:
- app content, suggestions, and calculations are general in nature,
- AI-powered scan and estimation features provide approximations only,
- food, nutrition, and protein data may be incomplete or inaccurate,
- you are responsible for reviewing your entries, estimates, and stored data,
- `PRTN AI` is not intended to diagnose, treat, cure, or prevent disease,
- `PRTN AI` is not intended for urgent medical decisions or eating disorder management.
If you have health concerns or need to make health-related decisions, you should seek medical or otherwise qualified professional advice.
## 8. Content, data sources, and third parties
`PRTN AI` uses third-party providers and external data sources, including in particular `Supabase`, `RevenueCat`, `Apple`, `Google`, `OpenAI`, `Google Gemini`, `Open Food Facts`, `USDA`, `UXCam`, `Amplitude`, `AppsFlyer`, `Meta/Facebook SDK`, `Brevo`, and optionally `Apple Health`.
Additional terms of third parties may apply to third-party services and content. We are not responsible for the availability or accuracy of third-party content or store terms.
## 9. Availability and changes
We aim to provide `PRTN AI` with high availability, but we do not guarantee uninterrupted or error-free availability.
Maintenance, updates, technical issues, security measures, or changes by third-party providers may result in temporary limitations or unavailability of certain features.
## 10. Term, termination, and account deletion
Use of the free features runs for an indefinite period.
You may delete your account at any time in the app settings or contact us at `jonathan@prtn.ai`.
We may terminate the user relationship for good cause, in particular in cases of:
- material or repeated breaches of these Terms,
- unlawful use,
- abuse of payment, advertising, or tracking-related features,
- risks to the security or integrity of our systems.
Any subscription purchased through an app store must additionally be cancelled in that store.
## 11. Liability
We are liable without limitation for intent and gross negligence and for culpable injury to life, body, or health.
In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage typical for the contract. Essential contractual obligations are obligations whose performance is necessary for the proper execution of the contract and on whose compliance you may regularly rely.
Otherwise, liability is excluded to the extent permitted by law.
The above limitations of liability also apply in favor of our legal representatives, personnel, and agents.
## 12. Privacy
Information about how personal data is processed can be found in the Privacy Notice at `https://prtn.ai/privacy`.
## 13. Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
## 14. Governing law and language
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer residing in another country, mandatory consumer protection laws of that country remain unaffected.
These Terms of Service are provided in German and English. In the event of contradictions or interpretation issues, the German version prevails.
## 15. Final provisions
If any provision of these Terms of Service is or becomes wholly or partially invalid, the validity of the remaining provisions remains unaffected.
